A Tender Is Not a Lottery — It’s a Process You Can Master
Most procurement procedures are not decided on the day bids are opened. The outcome is often determined much earlier: by the preparation and publication of procurement documentation, including the description of the subject matter of the contract, participation requirements, grounds for exclusion, bid evaluation criteria, responses to contractors’ questions, and details that are easy to overlook. We know these mechanisms inside out — as lawyers who have represented both sides — and we know where problems most often arise, before anyone even enters the procurement platform. We approach tenders like a game of chess, not a draw: every move matters.
Contractors most often lose their chance because of a rushed bid: a missing attachment, an error in the price calculation, or failure to complete other formalities. Tender committees rarely look for reasons to reject a bid — but the regulations leave little room for oversight. A single mistake can wipe out months of work and thousands of zlotys spent preparing the bid.
Contracting authorities, on the other hand, most often expose themselves to appeals through an imprecise or inconsistent description of the subject matter of the contract, or criteria or conditions tailored to a specific contractor. Even when a procurement procedure is successfully completed, an incorrect description may be challenged before the National Appeals Chamber (KIO) or during an audit — in which case the entire process may return to the starting point, resulting in delays to the project and loss of funding.
The result of this approach is straightforward: the contracting authority avoids months of delays and the cost of repeating the procedure, while the contractor does not lose a contract because of a mistake that could have been identified much earlier. A well-managed tender is about more than compliance with the law — it provides a real competitive advantage for one side and peace of mind for the other. That is why prevention is better than correcting mistakes after the fact, and why our clients come back to us for their subsequent procurement procedures.
