Warsaw is where disputes over the country’s largest public contracts are decided. Our office in Spektrum Tower at 18 Twarda Street is just a few minutes from the National Appeals Chamber — and in public procurement, deadlines are measured in days.

The Public Procurement Office and the National Appeals Chamber are located at 17a Postępu Street in Warsaw, while appeals against KIO rulings are heard by the Regional Court in Warsaw acting as the public procurement court. In the capital, procurement procedures are conducted by ministries, state-owned companies, teaching hospitals, universities, and major local government entities — often above the EU thresholds, through multi-stage procedures and with the participation of consortia. We represent both sides of procurement disputes: preparing appeals and interventions, representing clients at hearings before the Chamber, preparing responses to appeals, and drafting complaints to the court.

The Warsaw office also provides ongoing advisory services: audits of SWZ and the description of the subject matter of the contract before publication, reviews of competitors’ bids, explanations of abnormally low bids, negotiations, and amendments to public procurement contracts.

Public Procurement Services in Warsaw

The Warsaw office handles matters for two groups of clients: contractors participating in procurement procedures across Poland, for whom the capital is simply the location of the hearing, and contracting authorities from the Masovian region that need support in preparing and conducting procurement procedures. In both cases, we follow the same sequence: first, we analyse the documentation and risks, then determine the strategy, and only then prepare the submissions. Reversing this order is the most costly approach.

For contracts at or above the EU thresholds, the general deadline is 10 days from the date information about the contracting authority’s action is communicated by electronic means. Below the EU thresholds, the deadline is 5 days. Separate deadlines apply to the content of the contract notice and procurement documents. The deadline cannot be reinstated, so it is advisable to contact us on the same day you receive the relevant information.
